By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please do not use our website or purchase our products.

2. Definitions

For the purposes of these Terms & Conditions, the following definitions shall apply:

Agreement means the purchase agreement concluded between ZALDIVA and the Customer after ZALDIVA has accepted the Customer's order.

Business Day means Monday through Friday, excluding official public holidays in the Netherlands.

Consumer means a natural person acting for purposes outside their trade, business or profession, as defined under applicable consumer law.

Customer means any natural person or legal entity purchasing products through the ZALDIVA website.

Products means all goods offered for sale through the ZALDIVA website.

Website means the official ZALDIVA online store and all associated webpages operated under the ZALDIVA domain.

3. Applicability

These Terms & Conditions apply to every offer made by ZALDIVA and to every agreement concluded between ZALDIVA and the customer through our website.

Before an agreement is concluded, these Terms & Conditions will be made available electronically. If this is not reasonably possible, we will indicate how they can be obtained free of charge.

Any conditions proposed by the customer shall only apply if expressly accepted by ZALDIVA in writing.

If any provision of these Terms & Conditions is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.

4. Products

ZALDIVA makes every reasonable effort to ensure that product descriptions, images, colours and specifications displayed on the website are as accurate as possible.

However, actual colours and appearance may vary depending on your screen settings, lighting conditions and device.

Minor variations that do not affect the normal use of the product shall not constitute grounds for cancellation, replacement or compensation.

All product descriptions, specifications and prices may be changed at any time without prior notice.

ZALDIVA reserves the right to discontinue products or limit the quantity available for purchase at its sole discretion.

5. Product Availability

All Products offered on our Website are subject to availability.

Although we make every reasonable effort to keep our inventory accurate, stock levels may change due to simultaneous purchases, inventory updates or unforeseen circumstances.

Adding a Product to your shopping cart does not reserve that Product.

If a Product becomes unavailable after an order has been placed, ZALDIVA reserves the right to cancel the affected Product or the entire order.

If payment has already been received for an unavailable Product, the amount paid for that Product will be refunded using the original payment method within a reasonable period.

ZALDIVA shall not be liable for any damages arising solely from the temporary or permanent unavailability of a Product.

The Customer is responsible for ensuring that all billing, shipping and contact information provided during checkout is accurate and complete. ZALDIVA shall not be held liable for delays or additional costs resulting from incorrect or incomplete information provided by the Customer.

6. Orders

All orders placed through the Website are subject to acceptance and availability.

ZALDIVA reserves the right to refuse, cancel or limit any order at its sole discretion, including but not limited to the following circumstances:

• Fraudulent or unauthorized transactions;
• Payment failures;
• Abuse of promotions or discount codes;
• Obvious pricing or typographical errors;
• Inaccurate or incomplete Customer information;
• Resale or suspected commercial purchasing contrary to these Terms & Conditions.

If an order is cancelled after payment has been received, the Customer will be notified as soon as reasonably possible and any payment already received will be refunded using the original payment method.

The Customer is responsible for ensuring that all information provided during the ordering process is complete, accurate and up to date.

The Customer may not modify or cancel an order once it has been placed, unless otherwise agreed by ZALDIVA or required by applicable law.

7. Order Confirmation

After placing an order, the Customer will automatically receive an order confirmation by email.

This confirmation only acknowledges that ZALDIVA has received the Customer's order and does not constitute acceptance of the order.

An Agreement between the Customer and ZALDIVA is concluded only after ZALDIVA has expressly accepted the order or dispatched the Products.

If ZALDIVA is unable to accept an order, the Customer will be notified as soon as reasonably possible. Any payment already received will be refunded using the original payment method.

8. Prices and Payment

All prices displayed on the Website are shown in euros (€) and include VAT where required by applicable law, unless stated otherwise.

Shipping costs, taxes and any additional charges, where applicable, will be clearly displayed before the Customer completes the order.

ZALDIVA reserves the right to change prices at any time without prior notice. However, any price changes will not affect orders that have already been accepted by ZALDIVA.

Payment must be made using one of the payment methods offered on the Website at the time of purchase.

Orders will only be processed after full payment has been successfully received and verified.

If a payment is declined, cancelled or cannot be processed for any reason, ZALDIVA reserves the right to suspend or cancel the order.

The Customer warrants that they are authorized to use the selected payment method and that all payment information provided is accurate and complete.

Any refund approved by ZALDIVA will be issued using the original payment method, unless otherwise agreed or required by applicable law.

ZALDIVA is not responsible for any currency conversion fees, bank charges or payment provider fees charged by the Customer's bank or payment service provider.

9. Shipping and Delivery

ZALDIVA will make every reasonable effort to process and dispatch orders within the estimated processing times stated on our website.

Delivery times are estimates only and should not be regarded as guaranteed delivery dates. Delays may occur due to circumstances beyond our reasonable control, including carrier delays, customs inspections, severe weather conditions or other unforeseen events.

Risk of loss or damage passes to the customer once the order has been delivered to the shipping address provided during checkout.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping costs resulting from an incorrect or incomplete address may be charged to the customer.

10. Right of Withdrawal and Returns

Consumers within the European Union have the right to withdraw from their purchase within 14 days after receiving their order, unless an exception under applicable consumer law applies.

To exercise your right of withdrawal, you must notify ZALDIVA within the withdrawal period by contacting us at amor@zaldiva.eu.

Returned products must comply with the conditions set out in our Return Policy.

For hygiene reasons, we strongly recommend trying on the VALERIA Bodysuit while wearing your own underwear.

To be eligible for a return, the product must:

• Be returned within the applicable return period.
• Be complete, including all original accessories where applicable.
• Be in its original condition.
• Not be washed, altered or damaged.
• Only have been tried on as you would in a physical store.
• Be free from perfume, deodorant, make-up, stains, smoke, pet hair or other signs of use.
• Have the hygiene sticker on the thong section fully intact.
• Have the original one-time-use anti-counterfeiting tag still attached and undamaged.

Returns are subject to inspection by our authorized returns partner, R.E.D. Services. Only after the returned Product has been received and inspected will ZALDIVA determine whether the return complies with the conditions of our Return Policy. Returns that do not meet these conditions may be refused.

11. Privacy

ZALDIVA processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).

Our collection, use, storage and protection of personal data are described in our Privacy Policy, which forms an integral part of these Terms & Conditions.

By using our website, you acknowledge that you have read our Privacy Policy.

12. Intellectual Property Rights

All trademarks, trade names, logos, product names, photographs, graphics, videos, texts, website content and other intellectual property displayed on the ZALDIVA website remain the exclusive property of ZALDIVA or its licensors.

Nothing contained on this website grants any licence or ownership rights to any intellectual property.

Any unauthorized reproduction, distribution, modification or commercial use of our intellectual property is strictly prohibited and may result in legal action.

13. Errors, Inaccuracies and Corrections

Although ZALDIVA makes every reasonable effort to ensure that all information on the website is accurate and up to date, errors, inaccuracies or omissions may occasionally occur.

Nothing in these Terms & Conditions limits or excludes any statutory consumer rights that cannot legally be waived.

Where liability cannot be excluded, it shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless ZALDIVA, its owner, employees, partners, service providers and affiliates from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising from:

• Your misuse of our website or products;
• Your violation of any applicable law or regulation;
• Your infringement of the rights of any third party.

This indemnification does not apply where liability arises from ZALDIVA's own gross negligence or wilful misconduct.

19. Force Majeure

ZALDIVA shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

These circumstances include, but are not limited to:

• Fire or flooding;
• War, terrorism or civil unrest;
• Government measures or legal restrictions;
• Epidemics or pandemics;
• Transport disruptions;
• Customs delays;
• Strikes or labour disputes;
• Power outages;

During a force majeure event, our obligations will be suspended for the duration of the event. If the situation continues for an unreasonable period, both parties may terminate the agreement to the extent permitted by applicable law.

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision shall be interpreted to the maximum extent permitted by applicable law.

The remaining provisions shall remain valid and fully enforceable.

21. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Shipping Policy, Return Policy and any other policies expressly referred to on our website, constitute the entire agreement between ZALDIVA and the customer regarding the use of our website and the purchase of our products.

They supersede all prior agreements, communications and understandings relating to the same subject matter.

22. Assignment

Customers may not transfer or assign any rights or obligations arising under these Terms & Conditions without the prior written consent of ZALDIVA.

ZALDIVA may assign or transfer its rights and obligations where reasonably necessary, provided that doing so does not adversely affect the Customer's statutory rights.

23. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Netherlands.

Any disputes arising from these Terms & Conditions shall be submitted to the competent Dutch court, unless mandatory consumer protection laws provide otherwise.

24. Changes to these Terms & Conditions

ZALDIVA reserves the right to amend these Terms & Conditions at any time.

The most recent version will always be published on our website.

Material changes will only apply to new orders placed after the updated Terms & Conditions have become effective, unless applicable law requires otherwise.

26. Final Provisions

By using the ZALDIVA website or placing an order through our online store, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

These Terms & Conditions are effective from the date stated above and remain in force until replaced by a newer version published by ZALDIVA.
